USER AGREEMENT

1. Introduction

Welcome to MyPapik.

MyPapik is an online service where people can meet and build relationships based on their mutual interests.

Just like any other online service, we have our User Agreement (hereinafter referred to as the Agreement). The purpose of this Agreement is to define the range of obligations you as the User have when using our MyPapik service. It also serves to confirm your agreement with the general operation ideas and principles of our service as specified in the Agreement and Privacy Policy.

2. Terms

2.1.The following terms and definitions shall be used in the Agreement:

2.1.1."Service" shall refer to the service provided by the following website (as well as related IOS and Android applications): https://mypapik.com, which provides for the use of this platform for dating purposes by users having accounts of two types – Papik/Mamik (Daddy/Mommy) and Malysh/Malyshka (Baby Boy/Baby Girl). Recommendations shall be made based on user profiles, their network behavior as well as other information provided by the User.

2.1.2."User/you" shall refer a legally competent person who agreed to be bound by this Agreement at your own will. Please be advised that if you are under 18 years old (or even older if your country has a different age of majority) or if you are a representative of a legal entity we regret to inform you that we have to prohibit you from using our service and to ask you to leave our platform. You are welcome to come back to us when you become a legally competent person or when you reach the age of majority.

2.1.3."Verification Procedure" shall refer to the procedure of transferring the necessary information from User to MyPapik by filling in the appropriate fields during the registration of your user account or during your use of the service.

2.1.4."Agreement" shall refer to this Agreement with all addenda and amendments introduced as set forth herein.

2.1.5."Profile/Account" shall refer to the profile specially adapted to you in view of your personal needs and comprising all relevant data and other necessary information provided by you to the MyPapik service.

3. Subject of the User Agreement

3.1.Please be advised that you may encounter a lot of legal terms here, which may seem unclear, bureaucratic by nature or even inappropriate for a dating website. You are sure to find answers to most of your questions here but we just have to use more complicated language to ensure you and other users are safe and can use this service in a comfortable way without any inappropriate offers, spam, insults or fraud. We are confident you will understand us.

3.2.This Agreement shall define the terms and conditions for using the service as well as your obligations, and shall confirm your agreement with the Agreement and Privacy Policy as set forth herein for the period when you use the service.

3.3.The Agreement shall be considered accepted by the User in full and without any exceptions as of the time the User begins using the service/as of the time the User accepts the Agreement on https://mypapik.com or in the MyPapik application/as of the time the User registers an account on the MyPapik service.

3.4.You may not use the service in the event you disagree with the Agreement or Privacy Policy.

3.5.In the event you disagree with any changes introduced to the Agreement or Privacy Policy, you shall immediately stop using the service.

3.6.If you use the service/continue using the service in spite of the fact you disagree with the terms and conditions of the Agreement, the Agreement shall be considered accepted as implied by conduct, which is indicative of your acceptance of the terms and conditions of the Agreement and Privacy Policy.

4. General Terms and Conditions

4.1.By using the MyPapik service, you hereby confirm that:

4.1.1.You reviewed the terms and conditions of the Agreement in full prior to using the service.

4.1.2.By beginning to use the service in any form, you hereby accept all the terms and conditions of this Agreement in full and without any exceptions, restrictions or reservations on your part.

4.1.3.You are a legally competent person who is 18+ and who is of the age required to be able to use the MyPapik service, and you have the right to conclude this Agreement.

4.1.4.You agree that the Agreement may be amended without any special notice. The new version of the Agreement shall come into effect as soon as this version or a link to the website containing this new version has been published on the MyPapik service.

4.2.You are entitled to:

4.2.1.Enjoy using the service in accordance with this Agreement.

4.2.2.Contact the support service in case you have any questions or need any assistance, and we shall take every possible effort to solve your problem.

4.2.3.File a complaint against another user if this user’s behavior is inadequate and violates the terms and conditions of use specified for the service.

4.2.4.Protect your rights in every way possible, and we are ready to provide any assistance to you in this regard.

4.3.Misuse of the MyPapik service.

The main goal of the MyPapik service is to provide an enjoyable user experience of communication with the high standards of safety and comfort. In order to deliver this experience, the MyPapik service demands to follow the rules in accordance with requirements described in paragraph 4.3.1 of the present User Agreement

4.3.1.By registering for the MyPapik service and use account, User agrees and represents that the User will not misuse the MyPapik service and will comply with the MyPapik service rules, ethical and legal requirements. In particular, User will not use the Service:

  • to distribute any immoral, obscene, pornographic content or photos;
  • to distribute any radical political content or criminal information.
  • to distribute any defamatory, offensive, or otherwise illegal content or information;
  • to threaten or harass other users, or to infringe any third-party rights (including personal rights);
  • to upload any data to the MyPapik service, which contains a virus (such as infected software); or to upload data which contains a software or other content which is protected by copyright, unless you own the rights in that content or have otherwise obtained the necessary consents;
  • in such a manner that your use will adversely affect the availability of the MyPapik service to other users;
  • to intercept any e-mails / messages or to attempt to intercept them;
  • to send any e-mails / messages to users or use the video chat for any purpose other than to communicate, and in particular you will not use the MyPapik service to promote or to offer goods or services to other users except where this is expressly permitted by the MyPapik service;
  • to send e-mails / messages (including video messages) to users at an inappropriately high frequency or form;
  • to send introductory messages to an inappropriately high number of users within a very short space of time, and/or write inappropriately short or long introductory messages and/or contact requests (in such cases, the MyPapik service reserves the right to use technical means to set limits on such messages to ensure the security and integrity of the platform);
  • to send introductory messages followed by contact requests in violation of the recommended interval at least one day between them;
  • to send introductory messages with contact details like your full name, address, telephone, e-mail addresses, etc.;
  • to create messages using the “copy and paste” function or send any chain letters; and/or
  • to send any messages that serve a commercial purpose.

4.3.2.If User do not comply with the conduct requirements explained in Clause 4.3.1 of the present Agreement, or if User fail to materially comply with any other of the terms, the MyPapik service may take the following actions: ask User to stop the User non-compliant activities; delete any content which User have submitted via the MyPapik service in breach of any of the MyPapik service conduct requirements; suspend the provision of the MyPapik service to User (in whole or in part); ban account and terminate the provision of the MyPapik service to User.

5. Registration and User Accounts

5.1.To begin using the service, you need to complete the registration procedure to create a unique account.

5.2.In order to register, you shall provide accurate and complete personal information based on the questions in the registration form and shall keep this information up to date. The quality of the recommendations you will receive as well as quality of the overall service shall depend directly on the reliability of the information you provided. As a rule, we do not verify this information so you may want to put a positive spin on it.

5.2.1.However, in case your information is false creating discomfort for other users/administrators or affecting the correct operation of our service, we shall be entitled to do the following:

5.2.2.if you provide any false information or there are grounds to believe that the information you provided is incomplete or false, the MyPapik service shall reserve the right to disable or delete the User’s account and deny you access to the service at its sole discretion.

5.3.By registration User acknowledges and accepts that the data the User provide, as well as User behavior or comments may be subject to acts of moderation and/or control by the MyPapik service.

5.4.At least one submitted photo has to reflect the User face.

5.5.The photos submitted by Users shall not be illegal, pornographic, amoral, or represent a screenshot.

5.6.User agrees that during registration the MyPapik service checks and moderates the photos submitted by user.

5.7.The photos of User will be visible to other users after moderation.

5.8.Any confidential information provided by you shall be stored and processed in accordance with the Privacy Policy of the MyPapik service.

5.9.We are entitled to set restrictions and requirements for your use of the login and password for your account in order to ensure your account remains safe, which means that your login and password are to meet certain criteria, e.g. they must not contain certain characters, must consist of at least eight characters, and must meet other requirements as well.

5.10.We assume no responsibility for the security and reliability of the login and password you select to access your account.

5.11.All actions taken during the use of the service via a particular account identifying you shall be considered to be actions taken by you no matter who actually got hold of your account unless you have properly informed the administrators of the MyPapik service about the loss of access to your account.

5.12.Your account may be blocked, deleted or temporarily disabled in order to ensure the security of personal data or in case you have violated the terms and conditions of the Agreement or Privacy Policy.

6. Terms of Service

6.1.The MyPapik service does not guarantee continuous, fast or error-free provision of our services.

6.2.In view of the fact that the MyPapik service is being amended and updated on a regular basis, the functionality of the service may change from time to time without any prior notice to the User. If necessary, the administrators of the MyPapik service shall be entitled to terminate or restrict, either temporarily or permanently, the provision of the service (or any separate functions within the service) to all Users in general or only to you at their sole discretion and without any prior notice, and to disable or delete your account including but not limited to cases when you violate the terms and conditions of the Agreement or terms and conditions of any other valid legal documents posted on the service.

6.3.In case of any losses incurred to the User as a result of the use of the service, which shall be subject to determination of guilt, the User shall be indemnified for such losses in full but in the amount not exceeding one minimum wage.

6.4.The User shall not reproduce, duplicate, copy, sell or resell the service or any part of it, or use the service or any part of it for any commercial purposes.

6.5.The User agrees not to distribute any spam/information or messages that are offensive/ discriminatory/ harassing/ fraudulent or information that is pornographic by its nature, and agree to adhere to the norms of acceptable social interaction.

6.6.The User agrees not to carry out and be engaged to such activity, which lead to any form of begging, sponsorship, request of support, obtaining money from other user, gambling or cheating.

6.7.In the event the User violate the terms and conditions of the Agreement, your account may be disabled, blocked or deleted without any right to get a refund for the cost of the prepaid service.

6.8.The User agrees that the monthly Premium Subscription may be automatically renewed and that the User may also be charged automatically in this case. In the event you want to stop using the paid functions of the service, you shall manually cancel the subscription on your own.

6.9.You are aware that you shall not post any materials that can be interpreted as advertising something or as an insult in your profile/public comments/publications. In addition, all photos posted by you shall contain personal images of you as the User but not any other person.

6.10.You shall be solely responsible for your actions taken by using the service if they led to any violation of the rights and legitimate interests of any third parties. You are aware and agree that any of your interaction with other users by using this service as well as any negative consequences associated with the use of the service shall be your problem you shall be solely responsible for. We disclaim any responsibility for your violation of the rights of other users of the service or violations of your rights by other users of the service BUT we claim without reservation that we shall take every effort to make your user experience as positive as possible and to solve any problems that might arise when you use our service. At the same time, you are aware that by accepting this provision you shall forfeit the right to file a lawsuit against our company since you agreed to use our service at your own risk and peril.

6.11.You shall not share your account with anyone else or create multiple accounts.

6.12.You are strictly prohibited from offering any services on a paid basis including but not limited to sex services both in your own profile and in private correspondence with other Users.

6.13.In the event you reveal an account with false personal data or an account belonging to an underage person, you may report this account to the administrators of the MyPapik service.

6.14.You shall have no right to cause any harm, either physical or moral, to other Users or the MyPapik service.

6.15.You are strictly prohibited from using the service in order to obtain any confidential information of other people or from using the vulnerabilities of the MyPapik service in order to disrupt the operation of the service, cause any harm or violate the rights of other people.

6.16.You agree that the administrators of the MyPapik service shall be entitled but not obliged to conduct a preliminary check of any content posted by you on the MyPapik service and/or provided by you to the MyPapik service, and that the administrators of the MyPapik service shall be entitled to deny the User from posting the User’s content or to delete any content available via the service. You acknowledge and agree that you shall independently assess all risks related to the publication and distribution of such content including any assessment of the reliability, completeness and usefulness of the content.

7. Child Safety Standards

7.1.The MyPapik service is intended strictly for adults aged 18 years and older. Individuals under the age of 18 are not permitted to create an account, access the platform, or use any MyPapik services. The MyPapik service may suspend, disable or permanently remove any account suspected of belonging to an underage person.

7.2.The MyPapik service, operated by Redibu, has a zero-tolerance policy against Child Sexual Abuse and Exploitation (CSAE) and Child Sexual Abuse Material (CSAM). Users are strictly prohibited from creating, uploading, storing, sharing, requesting, distributing, promoting or making available any CSAM; grooming, soliciting, exploiting, trafficking, endangering or otherwise abusing minors; engaging in sexualized conversations involving minors or persons represented as minors; attempting to meet, contact or communicate with minors for sexual or exploitative purposes; impersonating a minor or falsely representing the age of any person for exploitative purposes; or encouraging, facilitating, promoting or normalizing any form of CSAE.

7.3.Any violation of this Child Safety Standards section may result in immediate content removal, account suspension, permanent account termination, and reporting to law enforcement authorities or relevant child protection organizations where appropriate or required by applicable law.

7.4.The MyPapik service provides tools that allow Users to report profiles, messages, photos, media, accounts or behavior that may violate this Agreement, including concerns related to child safety, CSAE or CSAM. Users may also block other Users.

7.5.The administrators of the MyPapik service may review reports, moderate content and accounts, and take appropriate enforcement action. The MyPapik service may use manual review and automated systems to detect, prevent and address illegal, harmful or abusive activity on the platform.

7.6.Redibu and the MyPapik service comply with applicable child safety laws and regulations. Where appropriate or required by law, Redibu and the MyPapik service may preserve and disclose relevant information and cooperate with law enforcement authorities, regulators and authorized child protection organizations in relation to suspected CSAE or CSAM.

7.7.Child safety concerns, including reports related to CSAE or CSAM, may be reported to the MyPapik service by email: support@mypapik.com. For urgent matters involving immediate danger to a child, Users should also contact local law enforcement authorities or emergency services.

7.8.Application name: MyPapik: Meet & Match. Developer: Redibu.

8. Cancelation and Refund policy

8.1.All charges paid by the User for purchases of MyPapik services and/or products are non-refundable, unless otherwise provided by MyPapik’s policies or required by applicable law.

8.2.If the User has signed up for a renewable service, they may cancel the renewal by sending a written cancellation request to support@mypapik.com within the applicable notice period:

  • For regular subscriptions, the request must be submitted no later than fourteen (14) days before the renewal date.

  • For 7-day subscriptions, the request must be submitted no later than three (3) days before the renewal date.

  • In case of cancellation, the User acknowledges and agrees that MyPapik is not obliged to provide any refund or compensation for the fully or partially used subscription period.

8.3.Users residing in the European Union (EU), European Economic Area (EEA), or the United Kingdom (UK) have the right to withdraw from the subscription and request a refund within fourteen (14) days from the date of signing up for the service or from the date of renewal, without providing any reason. To exercise this right, the User must send a refund request to support@mypapik.com.

8.4.MyPapik shall process and approve valid refund requests within fourteen (14) days from the date the request is received.

8.5.MyPapik may grant Users bonuses, credit units, or other promotional gifts, which can be used to access services and/or products within the MyPapik platform. Any unused bonuses, credit units, or gifts may become void and may be cancelled at the discretion of the MyPapik administrators.

9. Exclusive Rights to the Content of the Service

9.1.All items available via the service including but not limited to design features, text, graphics, illustrations, software, databases, music, sounds and any other content of the service as well as any content published on the service shall be subject to exclusive rights of the MyPapik service.

9.2.The User shall not use the content of the service in any form and for any purposes that are not set out in the functions of the MyPapik service, and shall not use the content of the service beyond the MyPapik service without prior consent of the rights holder.

9.3.You are advised to use common sense when posting or uploading your content on the MyPapik service or when sending your content from MyPapik to any person as you shall be solely responsible for it.

10. Websites and Content of Third Parties

10.1.The MyPapik service may contain links to other websites (websites of third parties). The administrators of the MyPapik service shall not review these third parties and their content for their compliance with certain requirements including but not limited to the requirements for reliability, completeness and validity.

10.2.The MyPapik service shall bear no responsibility for any information or materials posted on websites of third parties the User gains access to by using the service including but not limited to any opinions or statements posted on websites of third parties, advertisements or any other content as well as for the availability of such websites or content or consequences of their use by the User.

10.3.A link (in any form) to any website, product, service or any information of a commercial or non-commercial nature posted on the service shall not imply an approval or recommendation of these products (services, activities) by the MyPapik service unless otherwise expressly specified on the MyPapik service.

11. Advertising in the MyPapik Service

11.1.The administrators of the MyPapik service shall bear responsibility for any advertisements posted on the MyPapik service under the applicable law.

12. Contact Details of the MyPapik Service

12.1.The User may contact the support service of the MyPapik service with an enquiry in case of any questions or a need to solve certain problems related to the use of the service.

12.2.The support service shall reply to the User’s enquiry within 30 calendar days of the date of the User’s enquiry. This period may be extended up to a maximum of 90 days if this is necessary to review your enquiry. Email: support@mypapik.com

13. Other Terms and Conditions

13.1.This Agreement shall be an agreement between the User and administrators of the MyPapik service, which shall come into effect when the User agrees to the terms and conditions hereof according to the procedure as stipulated in Article 3 of the Agreement, and shall be in effect for the entire period when you use the service.

13.2.The Agreement shall be regulated and interpreted under the English law . Any issues not regulated in the Agreement shall be settled under the English law. All possible disputes arising out of the relations regulated by this Agreement shall be settled according to the procedure established by the laws chosen by parties.

13.3.The administrators of the MyPapik service may ask you at any time to verify the data provided during registration by providing the relevant documents, in particular documents that confirm your age.

13.4.Any failure to comply with the terms and conditions of Clause 11.3 hereof or provision of documents that make the administrators doubt their authenticity may be considered as equivalent to the provision of false information.

13.5.In the event any data specified in the documents you provided do not comply with the data specified during registration as well as in the event the data specified during registration are not sufficient for identifying the User, you may be denied access to your account or the use of the service.

13.6.If one or more provisions of the Agreement are found invalid or unenforceable for any reason, this shall have no effect on the validity or enforceability of the remaining provisions of the Agreement.

13.7.Any failure to act on the part of the administrators of the MyPapik service in case the User has violated any provisions of the Agreement shall not deprive the administrators of the MyPapik service of their right to take appropriate actions in order to protect their interests at a later stage, and shall not imply that the administrators of the MyPapik service waive their rights in the event of any further violations of a similar nature.

13.8.The original version of the User Agreement shall be in English and shall prevail over translations of this document in other languages.
