PRIVACY POLICY

This Privacy Policy for personal data (hereinafter referred to as the Privacy Policy) shall apply to all information about the User the MyPapik service may receive.

1. Terms

1.1.The following terms and definitions shall be used in the Privacy Policy:

1.1.1."Personal data" shall refer to any information related to the User (an individual being the data subject), either directly or indirectly.

1.1.2."Processing of Personal Data" shall refer to any action (operation) or a set of actions (operations) performed by automated means or without such means with regard to personal data including collection, recording, classification, accumulation, storage, improvement (update, change), retrieval, use, blocking, deletion or destruction of personal data.

1.1.3."Confidentiality of Personal Data" shall mean obligatory compliance with the requirement to prevent any distribution or prevention of unauthorised access to personal data without the User’s consent or any other legal ground.

1.1.4."Service" shall refer to the service provided by the following website (as well as related IOS and Android applications): https://mypapik.com, which provides for the use of this platform for dating purposes by users having accounts of two types – Papik/Mamik (Daddy/Mommy) and Malysh/Malyshka (Baby Boy/Baby Girl)

2. Subject of the Privacy Policy

2.1.This Privacy Policy defines the obligations of the MyPapik service not to disclose and to ensure privacy protection for personal data received from the User as a result of the use of this service.

2.2.The MyPapik service processes User data to deliver and improve its services and keep User safe.

2.3.User agrees to provide information about user’s profile (personal data), user’s network behavior as well as other necessary information about the User to obtain recommendations from the MyPapik service or to interact with other users.

2.4.Personal data allowed to be processed under this Privacy Policy shall be provided by the User by filling in the appropriate forms and granting permissions when using the service, and shall comprise the following information:

2.4.1.Full name of the User;

2.4.2.Date of birth;

2.4.3.Telephone number and other contact details;

2.4.4.Gender and Sexual orientation;

2.4.5.E-mail address;

2.4.6.Region of location as well as precise geolocation;

2.4.7.Information about other social network accounts (Facebook and Instagram);

2.4.8.Payment details;

2.4.9.Knowledge of foreign languages;

2.4.10.Information about the User’s sexual preferences;

2.4.11.Occupation as well as income level;

2.4.12.IP address, device ID and type, apps settings and characteristics, app crashes, advertising Ids.

2.5.The MyPapik service shall also collect data provided when the User contacts the support service to settle any issues that may arise during the use of the service.

2.6.User allows to the MyPapik service to access User camera or photo album to add certain content, like pictures or videos.

3. Purpose of Personal Data Collection

3.1.Personal dataare collected:

3.1.1.To ensure verification of the User and to contact the User;

3.1.2.Directly for the operation of the MyPapik service and for the provision of appropriate services to the Users;

3.1.3.For advertising and marketing purposes;

3.1.4.To connect the service to the payment system;

3.1.5.To monitor the Users’ compliance with the requirements set out in the terms of use of the service;

3.1.6.To improve the operation of the service as well as to develop and create new functions and services;

3.1.7.To detect, prevent, and fight fraud and other illegal or unauthorized activities;

3.1.8.To communicate with User about the MyPapik services.

4. Methods for Personal Data Processing

4.1.Personal data of the User are processed by any lawful method including but not limited to personal data information systems using or not using automated means.

4.2.In case of a loss or disclosure of personal data, the MyPapik service shall notify the User about such a loss or disclosure.

4.3.The MyPapik service shall take any necessary organizational and technical measures in order to protect personal data of the User against any unauthorized or accidental access, destruction, corruption, blocking, copying or distribution as well as against any other illegal actions of third parties.

4.4.By acting jointly with the User, the MyPapik service shall take all necessary measures in order to prevent any damage or other negative consequences that may be caused by a loss or disclosure of the User’s personal data.

5. Terms of Service

5.1.When providing services related to the use of the service, the MyPapik service, acting in a reasonable manner and in good faith, assumes that the User:

5.1.1.Has all the necessary rights enabling the User to register on the service and use the service;

5.1.2.Provides reliable information about himself/herself in the amount required to use the service;

5.1.3.Is aware that the information provided by the User to the service shall be collected and processed in accordance with the provisions of the Privacy Policy;

5.1.4.Has reviewed this Privacy Policy, agrees with it and its restrictions, and assumes these rights and obligations;

5.1.5.Has reviewed Google’s Privacy Policy (link: http://www.google.com/policies/privacy), agrees with it and its restrictions, and assumes these rights and obligations;

5.1.6.If the User wishes, at any time, to stop the transfer of confidential information and processing of his/her data received via Google services, the User may revoke this access by clicking the following links: https://myaccount.google.com/security , https://myaccount.google.com/permissions;

5.1.7.Has reviewed Facebook’s Privacy Policy (link: https://developers.facebook.com/terms/#privacypolicy, https://www.facebook.com/policy.php), agrees with it and its restrictions, and assumes these rights and obligations;

5.1.8.Has reviewed Spotify’s Privacy Policy (link: https://www.spotify.com/us/legal/privacy-policy/), agrees with it and its restrictions, and assumes these rights and obligations;

5.1.9.Has reviewed Twitter’s Privacy Policy (link: https://twitter.com/en/privacy), agrees with it and its restrictions, and assumes these rights and obligations;

5.1.10.Has reviewed Twitch’s Privacy Policy (link: https://www.twitch.tv/p/ru-ru/legal/privacy-notice/), agrees with it and its restrictions, and assumes these rights and obligations;

5.1.11.Has reviewed Reddit’s Privacy Policy (link: https://www.reddit.com/wiki/privacypolicy), agrees with it and its restrictions, and assumes these rights and obligations.

5.2.The MyPapik service shall not verify the accuracy of any information received about the Users unless such verification is required to provide services to the User.

5.3.In its turn, the MyPapik acknowledges that it is acting as an API client.

5.4.The User confirms that he/she is 18+ and is of the age required to be able to use the MyPapik service.

5.5.The User agrees not to distribute any spam/information or messages that are offensive/ discriminatory/ harassing/ fraudulent or information that is pornographic by its nature, and agrees to adhere to the norms of acceptable social interaction.

5.6.In the event the User violates Clause 5.5 of this Privacy Policy, the User’s account may be blocked, disabled or deleted without any right to get a refund for the cost of the prepaid service (Premium Subscription).

5.7.The User agrees that the MyPapik service may share the User personal information with third parties in order to provide service to User.

5.8.When the the MyPapik service transfers personal or non-personal information of User between companies placed in different jurisdictions the MyPapik service binding them to protect the privacy and security of the User data.

6. Data Deletion

6.1.User has the right to ask the MyPapik service to erase the User personal data. User can delete own personal data by clicking “Delete account” link in the Setting window of the application. By clicking the link, the User asks to erase personal data and initiates the process of the data deletion.

6.2.The MyPapik service has to delete User data and information on the User request.

6.3.Personal data of User are kept only as long as the MyPapik service needs it for legitimate business purposes in accordance with applicable law.

6.4.The MyPapik service shall not delete User data:

6.4.1.To protect public security;

6.4.2.To protect national security;

6.4.3.To protect the rights and freedoms of others;

6.4.4.To protect the safety and security of Users;

6.4.5.For fraud prevention;

6.4.6.To comply with legal obligations like tax, accounting requirements and preventing money laundering;

6.4.7.To defend the MyPapik service in the event of a claim;

6.4.8.To maintain information for dispute or legal proceedings.

6.5.The MyPapik service keeps profile data of users for one year in anticipation of potential litigation, for the establishment, exercise or defence of legal claims, and data necessary to prevent users who were banned from opening a new account, for as long as necessary to ensure the safety and vital interests of other users.

6.6.The MyPapik service keeps transaction data for five years to comply with tax and accounting legal requirements.

6.7.The MyPapik service keeps records of User consents given to the MyPapik service for five years to evidence compliance with applicable law.

6.8.Even User requests the MyPapik service to erase and delete personal data, the MyPapik service keeps records of User’s information shared by User with other user of the MyPapik service. Those users who access to shared by other user information will only have assess to shared information but not profile data of the other user.

6.9.Where the MyPapik service would be required to delete User personal data, but the personal data must be maintained for the purposes of evidence, the MyPapik service restricts its processing.

6.10.If the deletion of User personal data or information is prevented due to mandatory legal requirement and no processing will be needed, the User data and information will be blocked and stored for no other purposes, until it can be deleted.

6.11.If User uninstall the MyPapik application, this will not delete the User data.

6.12.In case of liquidation or insolvency the MyPapik service delete all personal data of users except the data, which must be kept archived for predetermined safekeeping period in accordance with the requirements of law.

6.13.The database with personal data and information can be transferred to a successor. The successor must make sure that all the affected users are told who holds their personal data. The successor takes all obligations and responsibility of MyPapik service. The successor must use the personal data and information in line with the purposes it was originally collected.

7. Account closure or ban

7.1.User can close own account.

7.2.The MyPapik service can ban or disable User account in case User breach the MyPapik service regulation or applicable law.

7.3.If User decides close own account the User’s profile will stop being visible to other users.

7.4.The MyPapik service will close User account automatically if User is inactive for a period of two years. After User account is closed, the User personal information will be deleted in accordance with section six of the present Privacy Policy.

7.5.The MyPapik service implements a safety retention window of three months following account closure, or one year following an account ban. During this period, the MyPapik service can keep User personal data and information to investigate unlawful or harmful conducts.

8. Contact Details of the MyPapik Service

8.1.The User may contact the support service of the MyPapik service with an enquiry in case of any questions or a need to solve certain problems related to the use of the service.

8.2.The support service shall reply to the User’s enquiry within 30 calendar days of the date of the User’s enquiry. This period may be extended up to a maximum of 90 days if this is necessary to review the User’s enquiry.

9. Validity and Amendments of the Privacy Policy

9.1.The User shall be notified of any amendments introduced in the Privacy Policy. If such amendments to the Privacy Policy are significant, the MyPapik service shall take every effort to inform the User about them. If such amendments to the Privacy Policy are insignificant, the MyPapik service shall inform the User about them by publishing an updated version of the Privacy Policy.

9.2.The original version of the Privacy Policy shall be in English and shall prevail over translations of this document in other languages.
